ACCOMMOZED GUEST AND TENANT AGREEMENT

This Guest and Tenant Agreement (“Agreement”) is entered into between AccommoZED Real Estate Limited (“AccommoZED”), a company duly incorporated under the Laws of the Republic of Zambia, having its registered office in Lusaka, Zambia; and the Guest or Tenant (“Guest” or “Tenant”), being the person or persons who make or confirm a booking or rental through the AccommoZED platform or any of its affiliated channels. By creating an account, making a booking, or entering into a rental through AccommoZED, the Guest/Tenant acknowledges that they have read, understood, and agreed to the terms of this Agreement.

1. DEFINITIONS

“Platform” means the AccommoZED website, social media pages, and any associated booking or listing channels operated by AccommoZED.
“Property” means the accommodation listed on the Platform by a Host, available for short-term or long-term occupancy.
“Host” means the property owner or their authorized representative or property manager responsible for the Property.
“Booking” means a confirmed reservation made through the Platform for a specified Property and stay period.
“Stay” refers to the period for which a Guest or Tenant has booked and paid to occupy the Property.
“Short-Term Stay” means a furnished rental of less than six (6) months.
“Long-Term Stay” means a furnished or unfurnished rental for six (6) months or longer.
“Service Fee” means any fee charged by AccommoZED to cover administrative, transaction, or platform costs.
“Security Deposit” means an amount held to cover potential damages or unpaid rent, refundable in accordance with this Agreement.
“Tenant” refers to a Guest occupying a property for a long-term stay under agreed tenancy terms.

2. SCOPE OF AGREEMENT

This Agreement governs all bookings, rentals, and stays arranged through AccommoZED, whether short-term or long-term.
AccommoZED provides a digital platform that facilitates bookings, communication, and payments between Guests/Tenants and Hosts. Unless AccommoZED has a property management contract with the Host, AccommoZED does not own or operate the properties and serves as a booking and facilitation channel.
For long-term stays, this Agreement also serves as the primary tenancy framework between the Tenant and the Host, outlining rights and responsibilities consistent with Zambian tenancy laws.
Where AccommoZED acts as the property manager, it shall perform management duties as set out in the Host’s Property Management Agreement.

3. BOOKING AND TENANCY CONFIRMATION

Bookings or tenancy applications must be made through the AccommoZED Platform or its authorized agents.
Confirmation occurs once full or partial payment is received and a confirmation notice is issued.
For long-term stays, additional verification (proof of employment, identification, or reference) may be required before final approval.
Tenancy commencement dates, rent amounts, and payment cycles will be confirmed in writing or electronically prior to occupation.

4. PAYMENTS

All payments for bookings or rent are processed through AccommoZED, which will remit funds to the Host or property manager after check-in or rent due date confirmation.
Prices listed on the Platform include applicable taxes, commissions, and transaction fees unless otherwise stated.
For long-term stays: Rent is payable monthly in advance, unless otherwise agreed; A Security Deposit (equivalent to one month’s rent, unless stated otherwise) is required before check-in and held by AccommoZED or the Host as agreed; Deposits will be refunded within 14 days after check-out, less any lawful deductions for damages or unpaid charges.
Non-payment of rent or breach of tenancy obligations may result in termination of occupancy and forfeiture of deposits in accordance with Zambian law.

5. CANCELLATION AND REFUND POLICY

Cancellations and refunds for short-term stays follow AccommoZED’s Cancellation and Refund Policy available on the Platform.
For long-term tenants, early termination of the lease requires at least one (1) month’s written notice unless otherwise agreed in writing.
Refunds for early termination will depend on the remaining lease term and re-letting of the property.
If the Host or AccommoZED cancels a confirmed stay or tenancy before check-in, the Guest/Tenant shall receive a full refund or alternative accommodation of comparable value, where available.

6. OCCUPANCY AND PROPERTY USE

The Property shall be used solely for residential purposes and may only be occupied by the persons named in the booking or tenancy agreement.
Guests/Tenants may not sublet, transfer, or assign their booking or lease without prior written consent from AccommoZED or the Host.
The Property must not be used for any illegal, immoral, or commercial activity that violates Zambian law or community standards.
Tenants shall comply with all estate, apartment, or neighborhood rules as applicable.

7. GUEST AND TENANT RESPONSIBILITIES

Treat the Property and its furnishings with care and maintain it in good condition.
Pay rent and utility charges (where applicable) promptly and in full.
Notify the Host or AccommoZED of any required repairs or damages as soon as they occur.
Refrain from making structural alterations, drilling, painting, or modifications without written permission.
Allow reasonable access to the Host, Property Manager, or AccommoZED for inspections or maintenance.
Return all keys, remotes, and access cards upon check-out or lease termination.
Be liable for the cost of repairing any damage caused by negligence or misuse.
Maintain cleanliness and proper waste disposal during their stay.

8. HOST AND PROPERTY MANAGER RESPONSIBILITIES

The Host or Property Manager shall ensure that the Property is safe, habitable, and in good repair before check-in.
They are responsible for managing check-ins, check-outs, and addressing issues during the stay unless AccommoZED is the appointed property manager.
For long-term rentals, the Host shall respect the Tenant’s right to quiet enjoyment and only enter the premises with reasonable notice or in emergencies.

9. MAINTENANCE AND UTILITIES (LONG-TERM STAYS)

The Tenant shall be responsible for utility payments (water, electricity, gas, internet, DSTV, etc.) unless otherwise stated in the listing or tenancy terms.
The Host shall be responsible for structural repairs, major plumbing, or electrical faults not caused by Tenant negligence.
Regular maintenance, cleaning, and minor repairs may be arranged through AccommoZED or third-party contractors, at the Tenant’s cost if damage is tenant-caused.

10. CHECK-IN AND CHECK-OUT

Check-in and check-out times shall be communicated in advance.
For short-term stays, Guests must present valid identification upon check-in.
For long-term stays, Tenants must sign an inventory checklist and condition report upon occupation and departure.

11. LIABILITY AND INSURANCE

The Guest/Tenant occupies the Property at their own risk. AccommoZED shall not be liable for injury, theft, or loss unless due to its negligence.
Guests/Tenants are advised to obtain personal property or renter’s insurance covering loss, damage, or accidents during their stay.
The Host shall maintain property insurance covering structural and major risk events.

12. TERMINATION

AccommoZED may suspend or terminate a stay or tenancy in cases of: Non-payment of rent or breach of terms, Illegal or disruptive activity, Misrepresentation or fraudulent conduct.
For long-term tenancies, termination procedures shall follow applicable Zambian tenancy laws, including the right to notice and due process.

13. PRIVACY AND DATA PROTECTION

AccommoZED will process all Guest/Tenant data in accordance with the Data Protection Act, 2021 (Zambia) and its Privacy Policy.
Information may be shared with Hosts, Property Managers, or legal authorities strictly for legitimate business or regulatory purposes.

14. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the Laws of the Republic of Zambia.
Any dispute arising shall first be resolved through amicable negotiation, and failing which, referred to arbitration under the Arbitration Act, Cap 40 of the Laws of Zambia.

15. ACCEPTANCE

By confirming a booking or signing a rental agreement through the AccommoZED platform, the Guest/Tenant confirms that they have read, understood, and agreed to this Agreement and all related policies (Cancellation, Refund, Privacy, etc.); they agree to abide by the property’s house rules and local laws; and they enter into a binding contractual relationship with the Host, facilitated by AccommoZED.
